Inland vs outland spousal sponsorship, and the spousal open work permit

Quick answer: You apply “inland” (the Spouse or Common-Law Partner in Canada class) when your spouse or common-law partner lives with you in Canada and has valid temporary status (or is covered by IRCC’s public policy for some out-of-status spouses). You apply “outland” (the Family class) in other cases, such as when your partner lives outside Canada. A sponsored spouse or partner living in Canada with you can apply for an open work permit once they have an acknowledgement of receipt (AOR) for the permanent residence application.

Who can apply inland?

IRCC’s complete sponsorship guide (IMM 5289) says to apply under the Spouse or Common-Law Partner in Canada class if your spouse or common-law partner:

The public policy covers a spouse or partner without status only when they are inadmissible for certain reasons listed by IRCC, such as overstaying a visa or permit or entering without a required visa. If they are inadmissible for other reasons, the public policy doesn’t cover them.

When should you apply outland instead?

The guide says to use the Family class (outside Canada) if:

If an application in the Family class is refused, IRCC says it will tell you about your right to appeal to the Immigration and Refugee Board (IRB).

Can my spouse leave Canada during an inland application?

Be careful. The guide warns that leaving Canada can automatically cancel temporary resident status as a visitor, student or worker, and that a partner who leaves may not be allowed to come back, especially if they need a visa to enter. If the inland application is refused, the spouse or partner must leave Canada at the end of their authorized stay.

Who can get the spousal open work permit?

IRCC’s open work permit page says a principal applicant can apply if they:

Accompanying dependent children can also be eligible if they live with the principal applicant and the sponsor. You apply online in your IRCC secure account. You are not eligible if the permanent residence application was refused, withdrawn or returned, and you can’t apply for this permit at a port of entry.

Can I apply for the open work permit before I get my AOR?

Only in one case. IRCC says you can apply without an AOR if your work permit, study permit or temporary resident status will expire in 2 weeks or less, and you applied for permanent residence under the Spouse or Common-Law Partner in Canada class or the family class as a spouse, common-law or conjugal partner (sponsored overseas).

What if my status has already expired?

If your permanent residence application is being processed under the spousal public policy for people without status, IRCC says you must wait until you receive your approval in principle letter before you can apply for an open work permit. You must apply on paper, and you can’t apply under another public policy or pilot program.

If your permanent residence application is still being processed, IRCC says you can extend this work permit for 2 more years if you meet its criteria.

How UW can help

In a paid consultation we review whether the inland or outland class suits your situation, check your partner’s status dates, and explain when the open work permit can be requested. IRCC decides all applications and no outcome is guaranteed.

Frequently asked questions

Can my spouse work while our inland sponsorship is processed?

They may apply for an open work permit once they have an AOR for the permanent residence application, if they live in Canada with you and have valid status.

Can outland applicants get the spousal open work permit?

The applicant must be living in Canada with the sponsor. IRCC’s page mentions applications under both the Spouse or Common-Law Partner in Canada class and the family class (sponsored overseas), but a partner who lives outside Canada does not meet the criteria.

What does AOR mean?

Acknowledgement of receipt. It confirms that the permanent residence application is complete and being processed. The AOR number starts with an F.

Can I appeal a refused inland spousal application?

IRCC’s guide lists planning to appeal a refusal as a reason to choose the Family class (outside Canada), where IRCC tells you of your right to appeal to the IRB.
